NASCAR Driver Tony Stewart Will Not Be Charged

On August 9, 2014, NASCAR driver Tony Stewart struck and killed fellow driver Kevin Ward, Jr. during a dirt track race in upstate New York.  The incident occurred when Stewart’s vehicle made contact with the car driven by Ward, causing it to spin out and stop on the racetrack.  Ward then exited his vehicle to confront Stewart and was struck by Stewart’s vehicle as the cars made their way around the track on the next lap.  Kevin Ward, 20, was killed upon impact.

The facts of the case were presented to a New York grand jury, which declined to indict Stewart on any criminal charges.  Citing the reasons for the decision, the presiding district attorney explained that Ward was under the influence of marijuana the night of the accident and that two videos of the incident showed no unusual driving by Stewart.
