The Legal Effects of Birth Defects

While most birth defects have an inexplicable cause and, therefore, no legal consequence, medical findings support a legal recovery in some birth defect situations. For instance, in a number of tragic cases, mothers who took Prozac (fluoxetine) during pregnancy ultimately gave birth to a child who suffered from persistent pulmonary hypertension (PPHN) and congenital heart defects.

 

In fact, health research determined recently that children who were experienced in utero exposure to selective serotonin reuptake inhibitors (SSRIs) like Prozac were 60 percent more likely to suffer from a heart condition as compared to children who did not experience SSRI exposure. This elevated risk level – and the fact that the manufacturer of these prescription drugs failed to fully disclose its product’s risks – have served as a basis for some families to effectuate a legal recovery.
